SYNOPSIS

OSH Act 1994 in Part VIII Section 32 (1) NADOPOD requires every employer stated in Schedule 1 must notify the nearest DOSH’s office of any workplace accident while Section 31 stated among the functions of Safety and Health Committee (SHC) is to investigate any matter at the place of work. Section 30 (4) A person who contravenes the provisions of any of the sections shall be guilty of an offence and shall, on conviction, be liable to a fine. The new OSH Act A1648 Amendment 2022 Section 30 (4) which received Royal assent on the 4th March 2022 and date of publication in the gazette 16th March 2022 and is expected to be enforced in 2023 will now carry a penalty fee from RM50,000.00 to RM500,000.00.

Therefore, it is crucial for every employer to take proactive action in the accident prevention effort. Unfortunately, the current method used for HIRARC and Incident analysis are considered outdated and not effective. Hence carrying out work, a detail risk assessment (HIRARC) during the planning stage and an effective incident investigation in order to identify the root causes and learning from incident (LFI) using the pictorial and diagrammatic method has its advantages and most importantly proven effective, recognised and widely used by industries in developed countries in Europe and UK since 2000.

As an HSE Consultants and expert specialising in Risk Assessment and Incident Investigation, the speaker will share his experience and the challenges faced in trying to convince safety practitioners and industry players in Malaysia to migrate and transform to this latest and proven methodology in preparation for the new OSH Act 2022Upon the enforcement of the law in 2023.


BIODATA OF SPEAKER

Ir. Mohamad Khalil Bin Ishak is the founder and Principal Consultant / Managing Director of KHALIL TRADING SERVICES SDN BHD (formerly known as KHALIL Safety Consultant). He is also the President of Association for Victim of Industrial Accident orPertubuhan Pembela Mangsa Kemalangan Industri (PPMKI).

He works in Oil and Gas industry (PETRONAS) for 25 years and very much involved in the operation and maintenance of refinery, petrochemical and gas plant equipment.

He owns a Master in Industrial Safety Management from Universiti Kebangsaan Malaysia (UKM) and Bachelor Degree in Mechanical Engineering from Swinburne University of Technology Melbourne Australia. He is certified trainer from NIOSH & HRDF and IRCA Lead Auditor for ISO 9001 (QMS), ISO 14001 (EMS), ISO 18001 (OHSAS). He is an active member for NIOSH, MSOSH and MyFOSH and been invited as speaker in conferences, seminars and workshops. His specialized area of expertise is in the area Risk Management using BowTie methodology and Incident Investigation using the Tripod Beta methodology and accredited ‘GOLD’ Tripod Beta practitioner and have successfully conducted trainings, workshops and consultation services to corporate and SME companies.

With his vast work experience working in the Oil & Gas industry for more than 25 years and supported by his qualification / accreditation at both national and international level, Ir. Mohamad Khalil Bin Ishak has been recognized by the Malaysia civil court as the only ‘Expert Witness’ to testify to the court on the underlying / root causes for industrial accident cases.
