SYNOPSIS

Engineering and construction is the sector with the most reported bribery and corruption in advanced economies globally as reported by Price Waterhouse Coopers in 2014. In Malaysia, corruption in the construction industry is at a “serious level”, says Malaysian Anti-Corruption Commission (MACC) state director Datuk  Bahri Mohamad Zin in a report by theStar on 25 Apr 2014.

Corruption in construction can reduce the efficiency, effectiveness and equity of infrastructure projects that resulted in construction projects that is unnecessary, unsuitable, and even defective. In order to control effectively the level of corruption  in construction, the critical factors of corruption in construction need to be correctly identified. Some studies indicate the main causes of corruption are  weakening of society values followed by bids and tender are ‘rigged’ and the third attributes was inefficient administration; while the consequences are consultants increase the quantities of work and share the awarded sum with contractors, demand payment for task carried out by consultants, and hike of cost due to the hidden cost. As for step to prevent corruption, would include implementing a comprehensive ethics program, establishing a corporate code of conduct and in the strong case, report it to the police or MACC.

The key anti-corruption legislation in Malaysia is the Malaysian Anti- Corruption Commission Act 2009 (MACCA), which came into force on January 2009. The relevant authority in charge of the MACCA is the Malaysian Anti-Corruption Commission (MACC). The MACCA applies to both the private sector and to public bodies / officers of a public body. The MACCA does not make a distinction between private sector bribery and bribery of public officials.

This presentation aims to share KLCC Projeks Services Sdn Bhd's own experience in combating corruption in construction through its implementation of the Antibribery Management System (ABMS), PETRONAS code of conduct and PETRONAS anti-bribery guidelines. It is hoped that the industry players will take heed of the consequences of corruption in construction both legally and economically, and move towards a "bribe free society".


BIODATA OF SPEAKER

En. Mohd Khairi Ibrahim, Head of Department, Business System & Performance Monitoring Department, had joined KLCC since 1992 and had more than 25 years’ working experience. He graduated in Bachelor Science Electrical Engineering from Indiana U - Purdue U, Indianapolis, USA in 1991. He was part of the pioneer team for the development of the PETRONAS Twin experience in design management and project management of building systems. He has also been involved in business planning & business development and project management capability development. His Department is in charge of the company's management systems i.e. ISO9001 and ISO37001. He was part of the team who had spearheaded the establishment and attainment of the MS ISO 37001 certification from SIRIM for the Company. Recently, he had completed the Certified Integrity Officer training organized by Malaysia Anti Corruption Academy (MACA).
